Amendment to the Act on Special Economic Zones

At the end of November the lower house of the Polish parliament passed an amendment to the Act on Special Economic Zones. The act was passed almost unanimously - 421 members voted for the act and only one member abstained.

The reason behind the changes is the fact that the regulations stipulated by the former act did not regulate the return of public aid granted in particular zones. As a result of the economic slowdown caused by the global crisis, many companies functioning in the zones had to reduce production and employment. Consequently, the employers threatened with the withdrawal of the permission for conducting business activity in the Special Economic Zone requested its termination believing that such a decision will protect them against the necessity of returning the collected public aid.

The amendment to the Act specifies the term "public aid" - it is an income tax exemption. A company which permission to conduct business activity in the Special Economic Zone was revoked will have to return the collected public aid. Additionally, the document provides a possibility to withdraw the permission for conducting business activity in the zone upon a request of the entrepreneur. The new regulations will come into force from January 1, 2015.
